If you do not agree to these Terms, you may not access or use the Platform. This Platform Trip4Cure.com is operated by PuraVidaTek LLC USA ("Company," "we," "us," or "our") and serves as a marketplace connecting users seeking medical care abroad with international healthcare facilities and providers.

2. NATURE OF SERVICE AND LIMITATIONS

2.1 Marketplace Platform Only

The Platform functions solely as a marketplace and facilitator connecting users with international healthcare providers and facilities. We are NOT a healthcare provider, medical professional, insurance company, or travel agency. We do not provide medical advice, diagnosis, or treatment.

2.2 No Medical Advice

Information provided on this Platform is for informational purposes only and does not constitute medical advice. You should consult with qualified healthcare professionals before making any medical decisions.

2.3 Voluntary Participation

All medical care obtained through this Platform is entirely voluntary. You are under no obligation to pursue medical treatment abroad, and you retain the right to seek care domestically.

2.4 Independent Contractors

Healthcare providers and facilities listed on the Platform are independent contractors, not employees or agents of the Company. We do not control, supervise, or direct the medical care provided by these entities.

3. USER ELIGIBILITY AND ACCOUNTS

3.1 Age Requirement

You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement.

3.2 Account Registration

To access certain features, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5.2 Provider Credentials

Healthcare providers listed on the Platform should maintain appropriate credentials and licensure in their respective countries. We provide access to physician licensing and outcome data, as well as facility accreditation and outcomes data, where available.

5.3 No Guarantee of Credentials

While we make reasonable efforts to verify credentials, we do not guarantee the accuracy, completeness, or currency of credential information. You are responsible for independently verifying the credentials and qualifications of any healthcare provider or facility before receiving care.

5.4 User Responsibility

You should check credentials of healthcare providers using search tools provided by relevant professional organizations and accrediting bodies before committing to receive care.

6. INFORMED CONSENT AND MEDICAL DECISIONS

Before agreeing to travel for medical care, you will be provided with comprehensive information about:

  • The proposed medical procedure or treatment
  • Qualifications and credentials of the healthcare provider and facility
  • Potential risks, benefits, and alternatives
  • Expected costs and what services are included
  • Follow-up care requirements and costs
  • Legal recourse and dispute resolution options
  • Potential risks of combining surgical procedures with long flights and vacation activities
6.2 Medical Records

You are responsible for ensuring that you receive a complete set of medical records before returning home to ensure continuity of care with your domestic healthcare providers. We will facilitate the transfer of medical records but cannot guarantee their completeness or accuracy.

6.3 Continuity of Care

Prior to travel, you should coordinate local follow-up care with your domestic healthcare provider. We encourage communication between your domestic provider and the international facility, but we cannot guarantee such coordination.

7. FINANCIAL TERMS

7.1 Platform Fees

The Platform may charge fees for connecting users with healthcare providers, facilitating arrangements, or providing concierge services. All applicable fees will be clearly disclosed before you commit to any transaction.

7.2 Medical Service Costs

You are responsible for all costs associated with medical care, including but not limited to: procedure costs, facility fees, physician fees, medications, follow-up care, and any complications or additional treatments required. All costs should be clearly itemized by the healthcare facility before you commit to treatment.

7.3 Payment Terms

Payment terms vary by healthcare facility. Some facilities require payment at time of service, while others may offer payment plans. You are responsible for understanding and complying with the payment terms of your chosen facility.

7.4 Insurance Coverage

You should carefully review your domestic health insurance plan to understand what services, if any, are covered for care received outside the United States. We do not guarantee insurance coverage or reimbursement for any services.

7.5 Refund Policy

Refunds for Platform fees are subject to our Refund Policy. Refunds for medical services are governed by the policies of the individual healthcare facility and are not controlled by the Company.

7.6 Currency and Exchange Rates

Prices may be quoted in various currencies. You are responsible for any currency conversion fees and acknowledge that exchange rates may fluctuate.

8. TRAVEL AND INSURANCE

8.1 Travel Arrangements

While we may facilitate travel arrangements, you are responsible for all travel-related decisions and costs, including flights, accommodations, ground transportation, and meals.

8.2 Travel Health Insurance

We strongly recommend that you purchase comprehensive travel health insurance and medical evacuation insurance before traveling for medical care. Such insurance should cover:

  • Medical complications arising from procedures
  • Emergency medical evacuation
  • Extended stays due to complications
  • Follow-up care upon return to the United States
8.3 Medical Complications Insurance

You should ensure that your insurance coverage includes costs of necessary follow-up care upon return to the United States, including treatment of any complications.

8.4 No Insurance Guarantee

We do not provide, guarantee, or endorse any insurance products. You are solely responsible for obtaining adequate insurance coverage.

RISKS AND DISCLAIMERS

9.1 Medical Risks

Medical tourism involves inherent risks, including but not limited to:

  • Complications from medical procedures
  • Infections, including antibiotic-resistant infections
  • Deep vein thrombosis and pulmonary embolism from long flights
  • Difficulty obtaining follow-up care
  • Language and cultural barriers
  • Differences in medical standards and practices
  • Limited legal recourse in case of malpractice
9.2 Travel Risks

International travel involves risks including but not limited to: infectious diseases, political instability, natural disasters, terrorism, and travel-related injuries.

9.3 Quality of Care

Standards of care, medical practices, and regulatory oversight vary significantly between countries. Care received abroad may differ substantially from care available in the United States.

9.4 Legal Recourse

If complications develop or you experience medical malpractice, you may not have the same legal recourse as you would if you received care in the United States. Medical malpractice laws, damage caps, and legal procedures vary by country.

9.5 Disclaimer of Warranties

THE PLATFORM AND ALL INFORMATION, CONTENT, AND SERVICES PROVIDED THROUGH THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE PLATFORM.

10. LIMITATION OF LIABILITY

10.1 No Liability for Medical Outcomes

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY MEDICAL OUTCOMES, COMPLICATIONS, INJURIES, DEATHS, OR OTHER HARM RESULTING FROM MEDICAL CARE RECEIVED THROUGH PROVIDERS OR FACILITIES ACCESSED VIA THE PLATFORM.

10.2 Limitation of Damages

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Platform
  • Any conduct or content of any third party on the Platform
  • Unauthorized access to or alteration of your transmissions or content
  • Medical care received from providers or facilities accessed through the Platform
10.3 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY IN PLATFORM FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.4 Basis of the Bargain

You acknowledge that the Company has set its prices and entered into this Agreement in reliance upon the limitations of liability set forth herein, which allocate risk between you and the Company and form a basis of the bargain between the parties.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your medical treatment received through providers or facilities accessed via the Platform
  • Any content you submit or transmit through the Platform

12. DISPUTE RESOLUTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of NJ, United States, without regard to its conflict of law provisions.

12.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules.

12.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and the Company individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class- action basis, and you waive any right to participate in a class-action lawsuit or class- wide arbitration.

12.4 Exceptions to Arbitration

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12.5 Disputes with Healthcare Providers

Disputes with healthcare providers or facilities are separate from disputes with the Company. You acknowledge that the Company is not a party to any dispute between you and a healthcare provider or facility, and such disputes must be resolved directly with the provider or facility in accordance with the laws of the country where care was provided.

13. INTELLECTUAL PROPERTY

13.1 Platform Content

All content on the Platform, including text, graphics, logos, images, software, and other materials, is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws.

13.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use.

13.3 Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any content from the Platform
  • Use any automated system to access the Platform
  • Attempt to gain unauthorized access to the Platform or its related systems
  • Use the Platform for any illegal or unauthorized purpose
13.4 User Content

You retain ownership of any content you submit to the Platform.   • Use the Platform to transmit spam, chain letters, or other unsolicited communications
  • Engage in any fraudulent activity

15. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for the content, products, services, or practices of any third party. Your interactions with third parties are solely between you and the third party, and you agree that the Company is not liable for any loss or damage incurred as a result of such interactions.

16. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

17. MODIFICATIONS TO PLATFORM

We reserve the right to modify, suspend, or discontinue the Platform or any portion thereof at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

18. TERMINATION

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including breach of these Terms.

18.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution.

19. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and the Company regarding the Platform and supersede all prior agreements and understandings.

21. NO WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

22. ASSIGNMENT

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
